LEASING STRATEGIES - EARLY LAWYER ENGAGEMENT: Retaining experienced legal counsel early in the commercial leasing process is probably the smartest and most cost-effective strategy that you could make (irrespective of your being landlord, tenant, subtenant, owner, developer or investor). The cost savings cannot be fully quantified, since a skilled leasing lawyer will negotiate out expensive lease conditions and clauses, advise you on business specific opportunities and strategies, and establish the basis for a more amicable business relationship where all of the parties clearly understand and respect their obligations under the lease agreement. You should never wait until the final lease agreement is about to be drafted and reviewed to engage legal counsel (although if you are at this stage, we are capable of minimizing your legal exposure and, where possible, re-negotiating injurious lease provisions that had been unwittingly agreed upon). Instead, you should be looking to engage the right leasing lawyer at the very outset of the process, even if it is simply to obtain their preliminary thoughts over the telephone.
