LEASE ASSIGNMENT / TRANSFER Allowing the transference of lease agreement from the current tenant to a new tenant should never be permitted without adequate review and consideration. Whereas most lease agreements provide for some type of assignment clause, all too often these particular clauses are weak or inadequate, such that tenants are known to shirk their legal and contractual obligations and oftentimes create a scenario where the landlord finds themself with a highly inferior tenant, who is incapable of meeting their requisite rent payment obligations. As such, major commercial landlords are extremely stringent in their oversight of lease assignments and other transfers, such that all other landlords would benefit from having a similar approach in their own lease agreements, such that they too might take highly assertive action when a lease assignment or other transfer is being sought.
